Battle Lines Drawn Against Unregulated Sweepstakes Gaming

A coalition of prominent sports betting operators has joined forces with the Indian Gaming Association (IGA) to combat the rise of sweepstakes gaming and daily fantasy sports (DFS) platforms. This collaboration aims to address what they perceive as illegal gaming operations that threaten the integrity of regulated gambling

The Sports Betting Alliance (SBA), which includes major players like DraftKings, FanDuel, BetMGM, and Fanatics Sportsbook, has stepped up to challenge the unregulated gaming sector. During a recent IGA webinar, Jeremy Kudon, president of the SBA, emphasized the need for industry leaders and tribal nations to unite against these operations.

“We are facing a pandemic in unregulated gaming,” Kudon stated, highlighting the urgency of the situation. He believes that this moment calls for collective action to safeguard the interests of regulated operators.

The IGA has long been a champion of tribal sovereignty and gaming compacts, advocating for the rights of tribal nations in the gaming arena. Recently, they declared that sweepstakes gaming and DFS are illegal in California, aligning with the SBA’s mission to curb these operations.

Victor Rocha, the chairman of the IGA conference, echoed this sentiment, stating, “We are at a crossroads, and if we do not act now, we will regret it.” The coalition aims to raise awareness among state officials and tribal leaders about the detrimental effects of unregulated gaming.

Sweepstakes gaming refers to platforms that offer free games and virtual currency, often allowing players to convert their winnings into cash or prizes. Unlike traditional sports betting, these platforms operate in a largely unregulated environment, which raises concerns regarding legality and consumer protection.

Platforms like Fliff Social Sportsbook and Chumba Casino have gained traction, particularly among younger audiences. They often promote free-to-play games, enticing users to engage without the immediate perception of risk. However, this model can lead to real monetary exchanges, blurring the lines between entertainment and gambling.

One of the significant concerns with sweepstakes gaming is the lack of age verification. Many sites do not enforce a minimum age requirement, making it easier for underage individuals to access these platforms.

According to Kudon, the sweepstakes gaming sector has already generated approximately $2 billion, with projections suggesting it could reach $4 billion by 2025. This revenue, which could otherwise benefit regulated operators and state coffers, is currently being siphoned off by unregulated entities.

The SBA has long focused on advocating for legal sports betting, which is subject to taxation and regulation. In contrast, sweepstakes gaming operates outside these frameworks, leading to an uneven playing field.

As of now, California does not have legalized sports betting or iGaming, making it a focal point for the sweepstakes gaming debate. The lack of regulation has allowed these platforms to flourish, raising questions about consumer protection and state revenue.

The coalition of the SBA and IGA is urging state lawmakers to take action against unregulated gaming. They believe that legal frameworks need to be established to protect consumers and ensure fair competition among gaming operators.

“It’s time for the federal government to step in,” Kudon mentioned, advocating for the Department of Justice to intervene against illegal gambling operations.

This is not the first time that tribal nations have fought against unregulated gaming. Previous battles against DFS operators like DraftKings and FanDuel serve as a backdrop to the current struggle.

For tribal nations, the fight against sweepstakes gaming is not just about legality; it’s also about sovereignty and economic survival. Tribal leaders have expressed their concerns regarding the influx of unregulated operators and the potential loss of revenue.

Rocha emphasized that tribal nations are not alone in this fight. The American Gaming Association (AGA) has also joined the cause, advocating for stricter regulations on sweepstakes gaming and DFS platforms.

The IGA and SBA are working to mobilize support from tribal leaders across various states, including California, Florida, and Oklahoma. They aim to create a unified front against unregulated gaming, emphasizing the importance of collaboration in this endeavour.
