SPA opened a consultation on draft ordinances addressing registration and operational capability recognition for service suppliers used by betting operators, with the contribution period running until March 23, 2026. This initiative directly affects game providers, betting platforms, KYC services, biometrics, geolocation services, and sports data providers.
SPA held a press conference at its headquarters in Brasília on February 10, where leader Regis Dudena outlined the rationale behind continuous regulatory review. Dudena explained that while the agency created a complete framework for the regulated fixed-odds betting market, regulation operates as a cycle requiring constant points of review and improvement. The technological nature of the betting market demands regulatory attention to emerging needs.
Stakeholders submit contributions through the federal Participa + Brasil platform, with an online public hearing scheduled for February 21. The proposed model introduces a two-step process comprising supplier registration and operational capability recognition, with the recognition phase potentially requiring local presence in Brazil. Acting Secretary Daniele Correa Cardoso issued Public Consultation Notice SPA/MF No. 1/2026, which opened February 4 and runs through March 23, 2026. SPA will publish its 2025-2026 regulatory agenda on April 4, incorporating feedback collected throughout the consultation period.
Participation in the consultation requires access through Portal Brasil Participativo, the federal government’s digital engagement platform. Interested parties must use their gov.br credentials to submit contributions. Both individuals and legal entities qualify for participation in the consultation process.
The platform operates on Decidim, an open-source software managed by Barcelona City Council, designed with a mobile-first approach reflecting Brazil’s digital landscape where 161.4 million people access the internet primarily via mobile devices. Brasil Participativo has demonstrated substantial reach, with over 1.5 million citizens contributing to the Pluriannual Government Plan and the platform being accessed 4 million times.
Submissions will only be considered valid if received within the official contribution window. Following the consultation period closure, SPA will evaluate all submissions in accordance with Article 31 of Decree No. 12,002/2024. A technical team will review the feasibility of each suggestion before incorporating relevant inputs into the final ordinance.
The Ministry of Treasury stated this public engagement process aims to improve regulatory enforcement and promote legal certainty across Brazil betting regulation. After the consultation concludes, the Ministry will publish results of the technical review.
Finance Minister Dario Durigan announced in June that the ministry would publish more than 25,000 documents relating to betting licensing. This measure aligned with the government’s commitment to providing transparency in Brazil sports betting regulation. The task force, composed of 15 members, operates in partnership with the Comptroller General of the Union.
The Ministry set a 120-day timeframe for completing the task force’s operations. Responsibilities include analyzing and identifying sensitive personal data requiring protection, then anonymizing such information before disclosure. The processed documents will be published progressively on the Ministry of Finance website, preserving privacy without compromising transparency regarding analyzes conducted by public administration. In effect, the SPA will incorporate lessons learned from the first authorization cycle into future regulatory frameworks.
