KSA Fines LeoVegas €500,000

The Dutch gambling authority, the Kansspelautoriteit (KSA), has imposed a fine on LeoVegas, due to lapses in player protection measures.

The KSA is tasked with overseeing the gambling landscape in the Netherlands, ensuring that operators adhere to strict regulations designed to protect consumers. One of the core tenets of these regulations is the duty of care, which mandates that gambling providers take proactive steps to mitigate the risks associated with gambling. This includes monitoring player behaviour and intervening when signs of problematic gambling are detected.

The duty of care is a fundamental principle that requires gambling operators to act in the best interests of their players. This involves:

• Monitoring Player Activity: Keeping track of players’ gambling patterns to identify any signs of distress or excessive gambling.
• Intervention Protocols: Establishing clear procedures for intervening when a player exhibits risky behaviour, such as significant losses over a short period.
• Providing Support: Offering resources and support to players who may be struggling with gambling addiction or related issues.

Findings of Non-Compliance

The KSA’s investigation into LeoVegas revealed multiple breaches of these duty of care obligations. The regulator reviewed player information files from the operator, covering a period from October 2023 to May 2024, and found that all examined cases demonstrated failures in player protection.

Examples of Breaches

1. Failure to Intervene: One notable case involved a player who incurred losses amounting to tens of thousands of euros within a brief timeframe. LeoVegas did not take timely action to address this alarming trend.
2. Inadequate Communication: Another instance highlighted a player showing serious signs of gambling harm who was only contacted through a dismissible pop-up notification. This approach was deemed insufficient for addressing the player’s needs effectively.

Michel Groothuizen, the Chairman of the KSA, expressed concern over LeoVegas’s lack of compliance with the duty of care. He emphasised that significant losses within a short period should trigger immediate action from operators. As a consequence of these compliance failures, LeoVegas has been fined €500,000.
