KSA Identifies AML Deficiencies With Online Operator

The Kansspelautoriteit (KSA), the Dutch gambling authority, has recently taken action against Tulipa Ent Limited, the operator behind the brands ComeOn and GetLucky. Following a thorough investigation, the KSA hsaid it had identified multiple deficiencies in Tulipa’s compliance with the Anti-Money Laundering and Counter-Terrorist Financing Act (AML/CFT).

Overview of the Enforcement Order

The KSA’s enforcement order mandates Tulipa to rectify its identified shortcomings within a specified timeframe. The regulator has set deadlines ranging from two to six months for the operator to address these issues. The KSA has indicated that Tulipa has been cooperative throughout the investigation and has already initiated steps towards compliance.

Key Findings from the Investigation

The KSA’s investigation revealed several areas where Tulipa fell short of the required standards:

1. Inadequate Client Due Diligence: Tulipa’s processes for conducting client due diligence were found to be insufficient. The operator failed to apply appropriate risk classifications and did not conduct thorough checks on transactions or the origins of player funds. This lack of diligence undermined the effectiveness of controls designed to detect potential financial crime.
2. Documentation Issues: The KSA noted that Tulipa’s record-keeping related to unusual transaction reports was inadequate. The failure to properly document these reports hindered the KSA’s ability to verify whether Tulipa met its reporting obligations to the Financial Intelligence Unit Netherlands.
3. Training Deficiencies: The training programmes provided by Tulipa were not tailored to the specific roles of employees, particularly those in compliance and anti-money laundering positions. Effective training is crucial for enabling staff to identify unusual activities and conduct comprehensive client checks.

The KSA has established clear deadlines for Tulipa to address the identified deficiencies. The operator is expected to implement corrective measures within the stipulated timeframe. Following the expiration of these deadlines, the KSA will conduct a follow-up inspection to assess the extent of compliance.

Tulipa’s cooperation during the investigation has been noted positively by the KSA. The operator has already begun to implement a recovery plan, addressing some of the issues identified during the review process.
