Nebraska sports betting could become reality following a ballot initiative scheduled for a late 2026 vote, marking a significant development in the state’s gaming landscape. The measure has cleared its first procedural hurdle, positioning Nebraska to join the growing number of states offering regulated wagering options. The proposed framework would establish market access guidelines for online sports betting Nebraska operators, particularly addressing licensing requirements and competitive structure. Furthermore, the initiative has sparked debate over financial projections, tax revenue potential, and concerns from various stakeholder groups about social impacts and regulatory oversight. The upcoming vote represents a pivotal moment for gambling expansion in the state.
Tax Relief Nebraska submitted signatures for two petitions to the Nebraska Secretary of State’s Office ahead of the July 2 deadline, launching the verification process that could place online sports betting Nebraska measures before voters in November. Lynne McNally, director of government relations for WarHorse casino, confirmed the group delivered more than 201,000 signatures for a constitutional amendment to legalize online sports betting and roughly 146,000 signatures for an accompanying statutory framework.
The submission numbers exceeded minimum requirements by substantial margins. Specifically, the constitutional amendment petition required approximately 126,000 signatures, while the regulatory measure needed about 88,000. The petitions began circulating in February after the committee raised more than $2.60 million in February and March alone, largely from two $1.10 million contributions from FanDuel and DraftKings.
The verification process involves all 93 Nebraska counties confirming the validity of submitted signatures. The statutory framework would direct 70% of revenues to property tax credits, matching the current casino tax allocation structure. McNally stated the campaign’s focus shifts to an informational effort emphasizing tax revenue retention within Nebraska rather than diverting funds to states where Nebraska sports betting residents currently wager legally.
Current Nebraska sports betting operates through four retail sportsbooks at WarHorse Casino locations in Lincoln and Omaha, Grand Island Casino Resort, and Caesars Sportsbook at Harrah’s Columbus. The proposed framework would establish online sports betting Nebraska access through licensed horse racing tracks, with oversight by the Nebraska Racing and Gaming Commission.
According to the petition, operators must host platforms on servers located within Nebraska and limit offerings to two platforms maximum. WarHorse Casinos, the state’s largest casino operator, has secured partnership commitments from DraftKings, FanDuel, BetMGM, Circa, and bet365. If approved, rules governing operations would take effect by June 1, 2027.
The current restriction drives residents to circumvent limitations through virtual private networks that mask device locations or prediction markets like Kalshi offering sports wagering. GeoComply data revealed more than 2,800 individuals crossed from Nebraska to Iowa during the 2024-2025 NFL regular season to place online bets legally, while 75,000 people faced blocks when attempting wagers from Nebraska.
Nebraska remains isolated regionally, as 32 states permit online sports betting, including all neighboring states except South Dakota. The framework would eliminate this geographic disadvantage while establishing controlled market entry.
Independent research commissioned by the petitioning group projects online sports betting Nebraska legalization could generate $87 million in new state tax revenue over five years, with approximately $61 million directed toward property tax credits. Casino industry representatives testified that Nebraska currently loses $30 million in annual tax revenue to states where online sports betting remains legal.
However, the Nebraska Family Alliance challenged these projections, stating the figures would imply Nebraskans spent roughly $435 million on online gambling during that period and provide less than 1% property tax offset. GeoComply data presented to the General Affairs Committee showed over 4.5 million blocked wagering attempts in Nebraska, with 118,000 unique mobile sports gambling accounts representing a 45% increase from 2023 to 2024.
Problem gambling concerns accompany revenue discussions. The National Council on Problem Gambling estimates 1% of U.S. adults have severe gambling problems, while another 2% to 3% experience mild or moderate issues, creating $14 billion in annual social costs nationally. Research indicates sports bettors face twice the rate of gambling problems compared to general gamblers, with 16% of online sports bettors meeting clinical criteria for gambling disorders. Financial impacts prove substantial, as legalization increased auto loan delinquencies by 0.55 percentage points and credit card delinquencies by 1.02 percentage points among consumers under 40.
