As a matter of fact, the National Lottery remains one of the largest operations of its kind globally. Since its launch three decades ago, the lottery has generated more than \u00a352bn for in excess of 670,000 good causes across the United Kingdom. The ruling raises questions about the grounds for Desmond&#8217;s challenge, the regulatory framework governing lottery licenses, and what this decision means for the future of the National Lottery.<\/p>\n<h4 style=\"text-align: left;\">High Court Rejects Desmond&#8217;s \u00a31.3bn Damages Claim<\/h4>\n<p style=\"text-align: left;\">Mrs Justice Joanna Smith delivered a 280-page judgment on Friday that dismissed Richard Desmond&#8217;s claims in their entirety.\u00a0The ruling found that The New Lottery Company failed over half of the 23 different mandatory requirements necessary for its bid to be considered.\u00a0An enormous gap of over 30 per cent separated TNLC&#8217;s scores from Allwyn&#8217;s bid during the procurement process.<\/p>\n<p style=\"text-align: left;\">The judge stated there was &#8220;really no basis whatever&#8221; for TNLC to claim the Gambling Commission had made a manifest error in its decision.\u00a0She concluded the claimants failed to establish that TNLC had any real chance of winning the competition, describing it as &#8220;fanciful to suppose that TNLC would have won&#8221; against Allwyn, characterized as a world leader in conducting lotteries.<\/p>\n<p style=\"text-align: left;\">In particularly sharp criticism, Mrs Justice Smith condemned the &#8220;apparently unfocused manner&#8221; in which TNLC argued its case.\u00a0She described the extent of this approach as &#8220;regrettable and, given the legal resources available to the claimants, inexcusable&#8221;.\u00a0The judge noted this led to significant time being wasted by other parties dealing with issues subsequently abandoned.<\/p>\n<p style=\"text-align: left;\">Legal costs in the case reached approximately \u00a370 million, with Desmond and his companies expected to foot the bill. A Northern and Shell spokesperson responded bluntly: &#8220;They won. We lost. We appeal.\u00a0It&#8217;s not over&#8221;.<\/p>\n<h4 style=\"text-align: left;\">Why Did Desmond Challenge the National Lottery License Award?<\/h4>\n<p style=\"text-align: left;\">Desmond&#8217;s companies, Northern &amp; Shell and The New Lottery Company, advanced two primary legal arguments in their case against the Gambling Commission.\u00a0The first centered on alleged flaws in the competition process itself.\u00a0Lawyers claimed the regulator wrongly deemed TNLC&#8217;s bid to have failed crucial criteria, imposed undisclosed requirements, and failed to provide feedback after the first phase that might have allowed improvements.<\/p>\n<p style=\"text-align: left;\">Furthermore, Desmond&#8217;s legal team argued Allwyn should have been disqualified on multiple grounds.\u00a0They pointed to alleged conflicts of interest affecting the regulator&#8217;s impartiality and claimed Allwyn breached strict rules against briefing the media.\u00a0The lawyers also highlighted connections between Allwyn&#8217;s Czech owner and Russian banks, which they said the commission failed to investigate properly.<\/p>\n<p style=\"text-align: left;\">The second strand of Desmond&#8217;s claim focused on contract adjustments made after the award.
