As the legislative session in Massachusetts approaches its conclusion on November 19, the fate of two online casino licensing proposals hangs in the balance. Senate Bill 235 and House Bill 332, introduced by Senator Paul Feeney and Representative Daniel Cahill, have faced delays since their referral to the Joint Committee on Consumer Protection and Professional Licensure earlier this year. With the deadline looming, fears by those involved are that the deadline will come and go without any movement towards online casinos.

The Current State of Online Casino Legislation

The proposed legislation aims to legalize and regulate online casino operations within Massachusetts, allowing the Massachusetts Gaming Commission (MGC) to oversee licensing and compliance. However, the bills have not progressed, raising concerns among stakeholders about the potential economic benefits that could be lost if the proposals are not passed.

If enacted, the legislation would impose a 20% tax on the adjusted gross revenue of online casinos, with a cap of ten licenses available for operators. This framework is designed to generate substantial tax revenue for the state, with estimates suggesting that Massachusetts could see an influx of approximately $275 million annually.

The Role of Existing Casinos

Under the proposed framework, each of the three retail casinos in Massachusetts would be permitted to partner with up to two online operators. Additionally, four standalone licenses would be available for other applicants. This structure aims to create a competitive environment while ensuring that established casinos can leverage their existing customer bases to enhance their online offerings.

To secure a license, operators would be required to pay a $5 million fee for a five-year permit, with the option to renew for the same amount.

Targeting Illegal Operators

In recent months, the Massachusetts Attorney General, Andrea Joy Campbell, has taken a firm stance against unlicensed online gambling sites. Cease-and-desist orders have been issued to operators such as SportsBetting.ag and BetOnline.ag, which have been accused of marketing their services to Massachusetts residents without proper authorization. This enforcement action highlights the state’s commitment to protecting consumers and ensuring that gambling activities are conducted within a regulated framework.

The Attorney General’s office has also launched initiatives aimed at educating the public about the risks associated with online gambling, particularly among young people. The Youth Sports Betting Safety Coalition, established in March 2024, aims to raise awareness about the potential harms of internet wagering.

Legislative Developments

While Massachusetts grapples with its online casino legislation, Ohio is also considering similar measures. House Bill 298 has received its first hearing, with proponents arguing that legalizing online casino games would bring the estimated $5 billion currently wagered illegally in the state into a regulated and taxable environment.

Ohio’s proposed tax rate of 28% is lower than the 33% imposed on brick-and-mortar casinos, raising concerns among industry stakeholders about potential market cannibalization. With a significant portion of sports bets already placed online, the implications of introducing online casino games could reshape the gambling landscape in Ohio, much like the anticipated changes in Massachusetts.

As the November 19 deadline approaches, Massachusetts lawmakers face a critical decision. The potential benefits of legalizing online casinos are clear, but the legislative process has been slow and cautious. Stakeholders are urging legislators to prioritize these bills to capitalize on the economic opportunities they present.

The outcome of this legislative session will have lasting implications for the future of online gambling in Massachusetts. If the bills are passed, the state could position itself as a leader in the online casino market, attracting operators and generating significant tax revenue.
