Bulgaria’s Gambling Advertising Ban Proposal Denied by Finance Ministry

Posted By Staff On Thursday, July 23rd, 2026 With 0 Comments

Bulgaria’s Finance Ministry has rejected opposition proposals for a Bulgaria advertising ban on gambling activities, citing concerns about market stability and regulatory effectiveness. The decision comes as the country grapples with significant black market challenges, notably with the gray sector currently representing approximately 40% of the gambling market. The Finance Ministry’s stance reflects a cautious approach to gambling regulation, balancing public health considerations against the risk of pushing operators further into unregulated territory. The rejection of the Bulgaria gambling ban proposals signals the government’s preference for comprehensive regulatory reform over targeted advertising restrictions. Bulgarian authorities have instead announced plans to review the country’s entire gambling legislative framework.

Finance Ministry Rejects Opposition Gambling Advertising Ban Proposals

Deputy Finance Minister Lyudmila Petkova declined opposition demands during budget committee discussions, rejecting proposals from “We Continue the Change” and “Democratic Bulgaria” for stricter Bulgaria advertising ban measures and increased gambling taxation. The opposition parties, former coalition partners before April elections, campaigned for near-complete marketing restrictions in densely populated areas and raising the GGR tax from 20% to 30%.

Venko Sabutev, an opposition MP advocating for the Bulgaria gambling ban, criticized the government’s refusal during parliamentary proceedings. “How could you change the Labor Code through transitional and final provisions, but not be able to change the Gambling Act and stop gambling advertising through the same mechanism?” he demanded.

Petkova warned that tax increases before addressing illegal operations would drive consumers toward unlicensed platforms. “The proposal to increase the tax sounds very good at first glance, but the real effect of the measure will be the transfer of players from the legal to the illegal market,” she stated. The government revealed Bulgaria’s channelization rate stands at approximately 60%.

Online gambling currently faces taxation at 25% of GGR alongside a 10% corporate tax, increased from the previous 20% rate earlier this year. Petkova confirmed the Finance Ministry would undertake a comprehensive gambling legislation review, noting that piecemeal amendments across various laws created enforcement challenges.

What Black Market Concerns Drive Bulgaria’s Cautious Approach?

Bulgaria already implemented sweeping advertising restrictions in 2024, creating a regulatory environment that makes authorities hesitant about additional limitations. The country’s current Gambling Act permits only narrowly defined advertising venues, specifically outdoor billboards positioned at least 300 meters from educational institutions, community cultural centers, playgrounds, schools, student hostels and facilities serving children.

Facade advertising remains permissible but cannot exceed 20% of the building surface or 50 square meters. Sports equipment, facilities, halls, stadiums and swimming pools can display gambling promotions, excluding materials intended for minors. All permitted advertising must dedicate at least 10% of space to the warning text: “Gambling poses a risk of developing addiction”.

The 2024 amendments significantly tightened restrictions, prohibiting gambling advertising in radio and television programs, public places including building facades, printed works and electronic media including websites, and state and municipally owned property. These comprehensive limitations already constrain operator marketing capabilities.

Bulgaria banned casinos in towns with fewer than 10,000 inhabitants. Authorities worry that layering additional restrictions onto this framework could eliminate legal operators’ ability to compete against unlicensed platforms, which face no advertising constraints. This concern drives the government’s preference for comprehensive legislative review rather than incremental Bulgaria advertising ban expansions.

Why Does Bulgaria Plan Comprehensive Gambling Act Review?

The Minister stated that regulatory changes over the years have been hastily added within other laws, which makes necessary corrections more challenging than required. “We are starting work on a comprehensive review of the Gambling Act. The reason is that amendments are regularly made to it between the first and second readings of other laws, and then years are needed to correct the consequences of the inaccuracies,” the Minister explained.

One such gambling-related change appeared in the 2026 Budget itself, envisioning the introduction of licenses for gambling affiliates to patch up the country’s deficit following a prolonged period of inflation that preceded Bulgaria’s accession to the Eurozone. This patchwork approach exemplifies the regulatory fragmentation authorities seek to address through comprehensive reform.

Future work to reform the gambling act will likely need input from the gambling regulator, the National Revenue Agency. The authority itself, which operates under the Ministry of Finance’s control, was left without a Director of Gambling Policies following Alexander Popov’s departure. This vacancy complicates the review process, as specialized gambling oversight requires dedicated leadership.

Las Vegas Sands Stock Slides on Disappointing Q2 Results

Posted By Staff On Thursday, July 23rd, 2026 With 0 Comments

Las Vegas Sands suffered a 3% decline in share value following the casino operator’s second-quarter earnings and revenue miss. The company’s Q2 financial performance fell short of market expectations, triggering immediate negative sentiment among investors.

The casino operator announced financial results for the second quarter of 2026 that fell below analyst expectations. Las Vegas Sands missed both profit and revenue estimates for the quarter. The company attributed the under performance to unusually weak VIP hold during the period.

These results contrast sharply with the first quarter of 2026, when net revenue reached $3.59 billion, marking a 25.3% increase compared to the prior year quarter. Operating income for Q1 2026 stood at $904 million, up from $609 million in Q1 2025. Net income for that quarter totaled $641 million, representing a 57.1% year-over-year increase.

The company’s consolidated adjusted property EBITDA in Q1 2026 hit $1.42 billion, showing a 24.6% rise from the previous year. Interest expense for that quarter amounted to $188 million. The weighted average debt balance during Q1 2026 was $16 billion, compared to $13.86 billion in the prior year period. The weighted average borrowing cost decreased to 4.6% from 4.9%.

Las Vegas Sands maintained its quarterly dividend at $0.30 per common share during the first quarter. The company also repurchased $740 million of common stock, approximately 13 million shares at a weighted average price of $56.64.

What Caused the Stock Price Decline?

Multiple operational challenges converged to impact Las Vegas Sands’ second-quarter performance, particularly in its Macau operations. EBITDA in Macau suffered from a low VIP rolling hold of 1.35%, creating a potential $87 million shortfall. President and Chief Operating Officer Patrick Dumont noted that Macau’s $566 million in EBITDA would have been $7 million lower without a higher-than-expected hold.

Management acknowledged strategic missteps in the region. “We are not aggressive enough as it relates to customer reinvestment,” stated Robert Goldstein, noting the company believed their buildings would suffice but proved wrong during the quarter. As a result, the team changed their approach to increase market share and EBITDA.

The FIFA World Cup significantly disrupted operations. Visitation to Marina Bay Sands and Macau properties decreased as high-value patrons shifted attention to the tournament. This impact appeared most pronounced in June, affecting gaming volumes throughout the quarter.

Operating expenses rose due to investments in additional table operating hours and enhanced customer service, which pressured short-term profitability. Intense competition in Macau’s premium segment required continuous investment in luxurious suite products and service levels. In Singapore, EBITDA would have been $107 million lower if hold had performed as expected.

Spelinspektionen Identifies Affiliates, Social Media as Black Market Channels

Posted By Staff On Wednesday, July 22nd, 2026 With 0 Comments

Spelinspektionen, Sweden’s gambling regulator has identified influencers as a prominent factor in promoting unlicensed online gambling services to Swedish consumers, according to a new regulatory report. The authority highlighted concerns about this activity, particularly in environments popular with young people, raising significant questions about consumer protection and enforcement. The regulator specifically pointed to affiliate marketing networks and link farms that redirect search traffic towards unlicensed casinos as primary promotional channels. Additionally, Spelinspektionen noted that some affiliates use Swedish domains to mask operators’ jurisdictions while targeting Swedish players.

Affiliates and Livestreaming Networks Emerge as Primary Channels

The regulator’s investigation revealed that many affiliate domains operated briefly, serving thousands of Swedish IP addresses, before disappearing and reappearing under new domains. This pattern of domain rotation allows operators to evade detection while maintaining continuous access to Swedish consumers. Some brand-specific affiliate landing pages employed Swedish (.se) domains but redirected users to English-language gambling sites, thereby obscuring the operators’ jurisdictions while specifically targeting Swedish players.

Livestreaming platforms emerged as significant distribution channels for unlicensed operators. Twitch and Kick served as venues where influencers distributed affiliate links and promotional codes connected to unlicensed operators. These platforms integrated features such as leaderboards and giveaways to attract viewers. Twitch subsequently banned several unlicensed sites; however, Kick emerged as an alternative for influencers previously removed from Twitch.

Enforcement actions produced measurable effects on major influencer promotions of unlicensed gambling. Some influencers responded by shifting their focus to international audiences or migrating to other platforms. The regulatory pressure forced adaptation rather than elimination of promotional activities, as operators and affiliates modified their distribution strategies to maintain reach while circumventing restrictions imposed by Spelinspektionen.

Social Media Giants Host Undisclosed Gambling Promotions

Major social media platforms including Meta, TikTok, Snapchat, and X hosted affiliate links, sponsored posts, and undisclosed promotions for unlicensed gambling services, according to Spelinspektionen. The regulator expressed particular concern about English-language comedy and influencer accounts that recently started producing Swedish-language content.

Deepfakes featuring Swedish public figures falsely legitimizing advertisements emerged as a sophisticated promotional tactic. These fabricated endorsements exploited public trust to lend credibility to unlicensed operators. Alongside traditional social media platforms, encrypted or semi-private messaging channels like Telegram disseminated affiliate links and organized giveaways.

Esports represented a prime area where skin-betting and crypto-casino sponsors engaged young audiences. Swedish visits to skin-betting sites increased following sponsorship of major tournaments. Data revealed that 17 percent of young people followed gambling companies through at least one social media or streaming platform. TikTok led platform usage at 10 percent, followed by YouTube at 9 percent, Instagram at 6 percent, and Snapchat at 6 percent.

Boys demonstrated higher engagement rates than girls, with 21 percent following gambling companies compared to 11 percent. Young people correctly classified only 43 percent of content marketing as advertising, compared to 65 percent of adults. This recognition gap underscored the effectiveness of undisclosed promotional strategies targeting younger demographics.

Spelinspektionen Intensifies Enforcement and Regulatory Measures

A criminal conviction in March 2026 resulted in a 22-month prison sentence for an influencer found guilty of economic crimes coupled with unlicensed gambling promotion, marking the first known online gambling promotion criminal sentence in Sweden. This prosecution signaled Spelinspektionen’s shift toward punitive enforcement measures.

Subsequently, new regulations tightening technical requirements for Spelpaus took effect from August 1, 2026. These updates feature marketing-related checks, tighter verification processes, and unique IDs for license holders. Operators must use unique Actor IDs and API keys when accessing the register, with mandatory checks required at registration, login, and before sending any direct marketing. The register itself received updates in 2023 to offer easier access to guidance and information on gambling problems, including an option for players to extend self-exclusion periods.

Responsibility remains firmly with license holders, even when third-party providers handle technical integration. The updated framework explicitly states that compliance obligations cannot be outsourced, making license holders liable regardless of vendor relationships.

Moreover, the proposed EU Digital Fairness Act, due to come into effect later this year, may introduce stricter rules on targeted advertising that could impact gambling marketing practices. This includes tighter restrictions on influencers and stricter transparency requirements for influencer marketing.

Bihar Assembly Passes Bill Banning All Forms of Gambling

Posted By Staff On Wednesday, July 22nd, 2026 With 0 Comments

The Bihar gambling ban became official reality as the state Assembly unanimously passed comprehensive legislation prohibiting all forms of wagering activities. Following the Union Home Ministry’s directive to states and Union Territories to replace the outdated Public Gambling Act of 1867 with modern legislation, Bihar introduced the Bihar Gambling (Prohibition) Bill, 2026. The new law encompasses physical and digital gambling platforms, including mobile app-based operations. Offenders face penalties ranging from six months to five years imprisonment, with fines between Rs 3,000 and Rs 1 lakh. For instance, online gambling violations carry mandatory minimum sentences of one year and fines starting at Rs 50,000. The legislation altogether defines gambling as any betting through physical, online, electronic, or virtual mediums aimed at financial profit.

Bihar Assembly Introduces Comprehensive Gambling Prohibition Bill

The state government introduced the legislation during the monsoon session on Monday, targeting both offline and online wagering operations across Bihar. The bill extends beyond general prohibitions to ban specific games of chance, including big baccarat, six-wheel, wheel of fortune, chemin de fer, craps, flush, brag, three-card game, keno, pontoon 21, roulette, slots, and super pan 9. The legislation grants the state government authority to specify additional games for prohibition from time to time.

The bill prohibits advertisement, printing, publication, or dissemination of information pertaining to gambling activities. Similarly, the legislation targets facilitators and advertisers with stricter enforcement measures. Betting encompasses putting money, virtual currency, digital currency, or any valuable at stake on uncertain event results, even if not legally recognized as currency. The bill defines a common gambling den as any public, commercial place, or online platform that facilitates wagering activities.

The Bihar gambling ban addresses electronic, computer, and mobile application-based operations alongside traditional physical venues. The legislation aims to curb the spread of gambling platforms across the state through enhanced enforcement and tougher penalties for violations.

Legislative Framework Behind the Bihar Gambling Ban

The constitutional authority for the Bihar gambling ban stems from Entry 34 of List II in the Seventh Schedule of the Indian Constitution, which places betting and gambling under the State List. This provision grants state legislatures exclusive authority to make laws on gambling matters.

Chief Minister Samrat Choudhary explained the legislative rationale, stating that the Union Home Ministry requested states and Union territories to revoke the Public Gambling Act, 1867 and introduce new legislation addressing current gambling trends. Therefore, the bill aims to replace the colonial-era law with the Bihar Gambling (Prohibition) Act, 2026.

The Public Gambling Act of 1867 remained in force across Bihar until this replacement. The outdated legislation proved inadequate for regulating modern gambling formats, particularly online platforms and digital applications.

The bill must pass through Bihar’s bicameral legislature before implementation. Once both houses approve the legislation, it requires the Governor’s assent and notification in the state gazette to become effective. This procedural framework ensures comprehensive review before the law takes effect.

The state’s legislative approach addresses changing gambling patterns through updated legal provisions suited to contemporary technology-driven wagering operations.

What Penalties Await Offenders Under the New Law?

Police officers holding sub-inspector rank or higher possess authority to search and arrest individuals found gambling or abetting gambling at public places under the Bihar gambling ban. Those caught participating in physical gambling face imprisonment up to six months or fines between Rs 3,000 and Rs 10,000.

Online gambling violations carry significantly harsher consequences. First-time offenders face mandatory imprisonment between one and three years, with fines ranging from Rs 50,000 to Rs 5 lakh. Repeat offenders receive prison sentences between two and seven years, along with fines from Rs 1 lakh to Rs 10 lakh.

Operators and managers of gambling establishments face six months to three years imprisonment and fines up to Rs 50,000 for initial violations. Subsequent offenses result in sentences between two and five years with fines reaching Rs 1 lakh.

The legislation extends accountability beyond direct participants. Individuals providing bank accounts, mobile apps, digital wallets, or other financial instruments for gambling transactions face up to six months imprisonment and fines up to Rs 10,000.

DR Congo Gambling Regulation: July 31 Deadline Set for Operator Registration

Posted By Staff On Wednesday, July 22nd, 2026 With 0 Comments

DR Congo gambling regulation is entering a new phase as authorities have set a July 31 deadline for all licensed and active gambling operators to register with the government. Operators that miss this deadline may face administrative sanctions and other penalties under existing law. The registration drive is managed by the Gambling and Games of Chance Supervision Unit (CSJA), established in January as the interim regulator while authorities work to create a permanent body, the Gambling Regulatory Authority (ARJA). In light of these regulatory changes, the Ministry of Finance is deploying a nationwide digital supervision platform to monitor DR Congo gambling operations, with the first implementation phase expected to conclude by August 30, 2026.

DR Congo Sets July 31 Registration Deadline for Gambling Operators

The Ministry of Finance issued the directive requiring each operator to complete an official identification form and submit it electronically before the deadline. This mandate covers companies involved in sports betting, casinos, lotteries, prediction games, and other gambling activities. According to the ministry, the registration process aims to make the gaming industry more accountable and transparent.

The directive extends reforms the government launched earlier in 2026 to improve compliance and revenue collection across the expanding DR Congo gambling market. The registration exercise is meant to improve tax administration and prepare the industry for a regulatory framework currently under review in Parliament, following approval from the Council of Ministers. This broader effort seeks to modernize the country’s gambling industry.

Operators must show they have begun the required compliance process to avoid administrative measures under existing regulations. The ministry clarified that operators do not necessarily need to complete their full technical integration by July 31, but must demonstrate they have started the process. In similar fashion, the March deadline focused on licensing and tax compliance, while the July and August deadlines relate to broader operator registration and gradual integration into the national monitoring system. The reforms provide licensed operators with a clearer regulatory environment.

How CSJA Manages the Transition to Permanent Gambling Authority

CSJA was created by a January 29, 2026, order to supervise DR Congo gambling regulation during the shift toward a permanent authority. Its interim board draws representatives from the Ministry of Portfolio, the National Lottery Company, the Central Bank of Congo, the Postal and Telecommunications Regulatory Authority of Congo, and national security agencies. The unit coordinates the move toward a single regulatory framework for the sector.

The reform follows directives issued during Cabinet meetings on November 8, 2024, and April 11, 2025. At the first meeting, the finance minister briefed the Cabinet on the reform’s progress. At the second, the Cabinet approved a bill setting basic rules for the DR Congo gambling industry. The bill regulates operating conditions, strengthens protections for minors and vulnerable gamblers, and defines the tax treatment of winnings and gross gaming revenue.

According to the ministry, the legislation remains under consideration in parliament. The current interim arrangement will give way to ARJA once that authority is formally constituted. Officials described the measure as necessary to maintain sector reforms within a unified national framework during the transition period.

Digital Platform Transforms DR Congo Gambling Oversight

Technical resources are being deployed within the Gambling Monitoring Unit to support the nationwide digital supervision platform, according to Didier Bobwa, head of the information system and monitoring of gaming operations. The platform complies with the ISO/IEC 27001:2022 standard for information security management, providing protection against cyber threats, unauthorized access and data loss.

Integration has already been completed for most electronic money institutions, while gambling operators are being connected according to a schedule set by CSJA [41]. The system will allow the government to centrally monitor DR Congo gambling industry activities and financial flows. Specifically, the platform is expected to provide real-time oversight of gambling operations across the country.

The reform addresses concerns about gambling addiction, money laundering, underage participation and mounting personal debt. Authorities are pursuing stricter supervision as the sector generates around USD 1.70bn annually, while the state receives only about USD 1.00m in revenue. This gap between gambling activity and government revenue collection underscores the need for stronger oversight.

Washington Court Halts Kalshi Sports Prediction Markets

Posted By Staff On Wednesday, July 22nd, 2026 With 0 Comments

Kalshi faces a major regulatory setback as a Washington state court has granted a preliminary injunction blocking the platform from offering sports-related prediction markets to state residents. Judge McHale rejected federal preemption arguments, ruling that Washington retains authority to regulate Kalshi prediction markets within its jurisdiction. The decision adds to mounting state-level challenges against the platform, with states winning 19 of 23 injunction decisions. However, regulatory pressure has not dampened trading activity, as Kalshi reported $33bn in June trading. The court plans to review additional filings by Aug. 3, with the injunction taking effect no earlier than Aug. 5.

Washington Court Issues Preliminary Injunction Against Kalshi

King County Superior Court Judge John McHale ruled that Washington state demonstrated a likelihood of success in proving Kalshi violated multiple state statutes. The court found violations of the Washington Gambling Act and the Consumer Protection Act, determining that Kalshi operates, develops, manages, finances, and profits from illegal gambling activities in Washington. Judge McHale characterized the platform’s operations as conducting unlicensed gambling games, bookmaking, and professional gambling with respect to betting on sports, elections, politics, entertainment, and culture.

The court rejected Kalshi’s central defense that the Commodity Exchange Act preempts state gambling laws. Judge McHale ruled that regulation of gambling and regulation of futures markets constitute different fields of regulation, noting that Congress did not intend to supersede state jurisdiction in addressing gambling regulation. The judge determined that complying with Washington law would not prevent Kalshi from complying with federal requirements.

Attorney General Nick Brown stated that Kalshi promoted illegal betting on sports, elections, measles cases, witness testimony during child trafficking hearings, and natural disasters. The court found that Kalshi’s advertising claiming to offer “legal betting” in Washington likely misleads reasonable consumers. Judge McHale directed both parties to confer on injunction terms by Aug. 3.

How Kalshi’s Legal Battle Extends Across Multiple States

Kalshi prediction markets face legal challenges spanning more than 20 states, with lawsuits filed from multiple directions. Eight lawsuits originated from state gambling commissions and Indian tribes accusing Kalshi of operating an unlicensed sports gambling platform, while six suits represent Kalshi on the offensive, suing state regulators and contending they fall outside state gambling rules. Five additional complaints came from individuals arguing Kalshi worsens gambling addiction, with four seeking class-action status.

Michigan Attorney General Dana Nessel filed suit earlier this year, arguing the company violated the Michigan Lawful Sports Betting Act. Judge Rosemarie Aquilina granted a temporary restraining order on June 29, stating Michigan’s most vulnerable citizens would suffer immediate and irreparable harm from being exploited by Kalshi’s sports betting operation masquerading as an investment opportunity.

Nevada presents a notable case trajectory. District Judge Andrew Gordon initially granted a preliminary injunction in April 2025 barring state gaming authorities from enforcement. Conversely, Judge Gordon dissolved the injunction in December, holding that certain sports-related contracts closely resemble traditional sportsbook bets and fall within Nevada gaming laws. Carson City District Court Judge Jason Woodbury subsequently extended the ban, describing Kalshi’s sports contract wording as indistinguishable from placing a bet at a state-licensed sportsbook.

Federal courts in Tennessee, Ohio, Connecticut, and New York temporarily paused state enforcement while preliminary injunction motions remain under consideration.

New York Ruling Reinforces State Authority Over Prediction Markets

U.S. District Judge Analisa Torres denied Kalshi’s motion for a preliminary injunction that would have blocked New York state regulators from enforcing gambling laws against the prediction market platform. The ruling, issued late Tuesday, found that Kalshi failed to demonstrate likelihood of success on preemption claims under the Commodity Exchange Act.

Torres pointed to a provision in Section 2 of the Commodity Exchange Act stating that nothing in the section shall supersede or limit jurisdiction conferred on other regulatory authorities under state laws. The judge wrote that this provision evidenced Congress did not intend to regulate so broadly as to exclude all state gambling laws from regulating transactions involving swaps.

Kalshi sued New York officials in October 2025 after receiving a cease-and-desist letter for offering sports gambling without a license. Torres noted that New York law requires any gambling enterprise offering sports gaming to obtain a license from the Gaming Commission. The judge emphasized nothing prevents Kalshi from obtaining a license pursuant to New York law.

Governor Kathy Hochul and Attorney General Letitia James issued a joint statement Wednesday morning celebrating the victory. Kalshi is appealing the decision to a higher court. Meanwhile, New York has proposed the ORACLE Act legislation designed to regulate prediction exchanges more tightly. The CFTC preemptively countersued the state to block enforcement of any laws claiming to usurp federal authority.

Senator Heinrich, New Mexico Tribes Push to Regulate Prediction Markets

Posted By Staff On Tuesday, July 21st, 2026 With 0 Comments

Kalshi one of the biggest companies within Prediction market betting

Prediction markets are drawing fierce opposition from New Mexico lawmakers and Indigenous leaders who warn these unregulated platforms threaten tribal gaming operations. U.S. Senator Martin Heinrich, alongside 16 tribes and pueblos in New Mexico, is calling on Republican senators to restrain online gambling applications. The rapid expansion of these apps, which allow users to bet on sports and engage in casino-style gambling, poses an existential threat to tribal sovereignty by undermining revenue that tribes rely on for government services. Being that sports gambling remains illegal in New Mexico except at tribal casinos in person, these operations fund essential services including education, public safety, healthcare, and housing. The coalition seeks regulatory measures to protect prediction markets New Mexico tribal communities depend on for their economic foundation.

Heinrich and New Mexico Tribes Unite Against Unregulated Prediction Markets

Heinrich sent the letter on Friday to Republican chairmen of the Senate Committees on Banking, Housing, and Urban Affairs and Agriculture, Nutrition, and Forestry. The letter urges both committees to amend pending legislation that deals with digital assets, specifically the CLARITY Act and the Digital Commodity Intermediaries Act. Eleven other Democratic senators joined Heinrich in this effort, including Tina Smith of Minnesota, Maria Cantwell and Patty Murray of Washington, Richard Blumenthal of Connecticut, Mark Kelly of Arizona, Tammy Baldwin of Wisconsin, Alex Padilla and Adam Schiff of California, Jacky Rosen of Nevada, Brian Schatz of Hawaii, and Gary Peters of Michigan.

The coalition backing this action extends beyond elected officials. Sixteen New Mexico tribes and pueblos signed the letter, coupled with support from the Indian Gaming Association and National Congress of American Indians. These tribal governments seek specific amendments prohibiting Commodity Futures Trading Commission-registered entities from listing prediction contracts that resemble sports bets or casino-style gaming products.

This push reflects broader concerns in the Senate about prediction markets. A separate group of 16 Senate Democrats, led by Amy Klobuchar of Minnesota, previously called on the CFTC to tighten regulation of these platforms. Senators warned that event contract trading volume has grown exponentially over the past 18 months.

How Prediction Markets in New Mexico Threaten Tribal Sovereignty

Platforms like Kalshi operate outside the Indian Gaming Regulatory Act framework, which positions them as what Brookings Institution scholar Patrice Kunesh describes as an existential threat to tribal gaming. The conflict centers on jurisdictional authority: prediction markets claim protection under the Commodity Exchange Act and CFTC oversight, arguing their sports event contracts qualify as derivatives rather than gambling subject to IGRA regulations.

Three New Mexico pueblos and one tribe filed suit in May 2026 against Kalshi, with the Mescalero Apache Tribe, Pojoaque Pueblo, Sandia Pueblo, and Isleta Pueblo alleging the platform violates gaming compacts and federal law. The plaintiffs noted Kalshi provides anyone over age 18 access to sports gambling, while New Mexico tribal casinos require patrons to be 21 or older under state compacts and federal law. Consequently, this age disparity removes regulatory guardrails tribes maintain to deter gambling addiction.

Tribal gaming generates more than $40 billion annually, funding healthcare, housing, education and social services in Native American communities. New Mexico tribes reported generating more than $266 million in adjusted net win during the last quarter of 2025. For comparison, Kalshi alone pulled in more than $2.5 billion on sports event contracts in September 2025, coinciding with the NFL season start.

What Legislative Amendments Could Protect Tribal Gaming Rights

The coalition requests two specific amendments to the CLARITY Act. The first would prohibit federally regulated platforms from offering contracts tied to sports or casino-style outcomes. Sports event contracts have been the main source of conflict with state regulators and tribal gaming interests, which argue that the products amount to unlicensed sports wagering.

Tribal leaders contend prediction markets undermine sovereignty by relying on the fiction that sports bets are “swaps,” violating government-to-government agreements tribes have built with their states. The revenues threatened fund healthcare, education, housing, public safety, language preservation, and essential government services.

The second provision would clarify that the CLARITY Act does not override existing tribal, state or federal gaming laws, including IGRA. The bill does not expressly say that it preempts IGRA, but tribes want Congress to eliminate any potential ambiguity before it becomes law. Sports betting qualifies as Class III gaming under IGRA and is permitted if included in a tribal-state compact.

IGA’s concern centers on cryptocurrency-based prediction markets using an expanded federal framework to strengthen arguments that they may offer gambling-like products nationwide without complying with tribal or state gaming laws. Without proposed protections, CLARITY “could unintentionally allow cryptocurrency-based prediction markets to expand online gambling nationwide”.

The campaign expanded in February, when IGA brought together tribal leaders, the National Congress of American Indians, commercial gaming groups and consumer advocates for a congressional briefing. The coalition announced a task force to coordinate legislative, regulatory and legal responses.
