Massachusetts Online Casino Bill Shelved, Halting Gambling Expansion

A Massachusetts online casino bill has been effectively shelved after the Joint Committee on Economic Development and Emerging Technologies voted 11-0 to move it to study. The decision represents a legislative strategy that typically signals the end of a proposal’s chances for the current session. Rep. David Muradian Jr. (R) sponsored bill H.4431, which aimed to authorize the state’s three casinos to offer online gaming. The Massachusetts online casino bill proposed allowing Plainridge Park Casino, MGM Springfield, and Encore Boston Harbor to operate up to three online gaming skins each. Additionally, the framework included a 15% tax on gross revenue, a $100,000 application fee, and an additional $50,000 fee per skin.

Massachusetts Online Casino Bill Receives Study Order

The committee’s decision on Monday to assign the Massachusetts online casino bill to study effectively ended its prospects for the current legislative session. In reality, study orders serve as a legislative mechanism to quietly terminate proposals, according to the Massachusetts Bar Association. The measure would have established Chapter 23O as new state law, granting the Massachusetts Gaming Commission regulatory authority over internet gaming operations.

Muradian defended the legislation at a November hearing, stating it would bring internet gaming “out of the shadows into a safe, transparent, and accountable system”. He emphasized the framework would keep tax revenue within Massachusetts rather than directing it overseas. The bill attracted support from proponents who viewed it as a method to curb illegal gambling while generating state tax revenues.

Opposition centered on concerns about market cannibalization and public health impacts. Critics argued the Massachusetts online casino bill would divert customers from retail casinos, resulting in job losses and reduced tax collections. Additionally, opponents raised concerns about potential increases in gambling addiction.

The Massachusetts Gaming Commission separately initiated research into iGaming’s public health impacts, budgeting £59,562.01 for studies examining problem gambling comorbidity and effects on individuals under 25. Muradian announced plans to refile the legislation for the 2027-2028 session.

How the Proposed Framework Would Have Operated

The Massachusetts online casino bill outlined specific operational parameters for digital gambling platforms. Licensed operators would have been permitted to offer slot machines, table games, blackjack, and poker through their online platforms. The Massachusetts Gaming Commission would have assumed regulatory oversight, extending its current authority over casino gaming, horse racing, and sports wagering to include internet gaming.

Consumer protection measures formed a central component of the proposal. Operators would have faced requirements to monitor user behavior for signs of problem gambling and implement age and location verification protocols. The legislation set deposit limits, capping contributions at $20,000 within a 24-hour period. Credit card usage for deposits would have been prohibited, while advertising practices would have faced restrictions.

The framework targeted unregulated alternatives by banning dual-currency sweepstakes gaming platforms. Violations would have resulted in fines between $10,000 and $100,000, with repeat offenders facing potential imprisonment[21]. Accordingly, the bill’s postponement allows sweepstakes operators to continue functioning within the existing legal gray area.

Revenue from internet gaming would have funded a Player Health Program focused on gambling addiction awareness and an Internet Gaming Fund. Each casino operator would have partnered with external digital providers to launch multiple branded platforms.
