Peru To Greenlight Online Gambling But With Hike in Fees

Peru is poised to embark into the gambling industry, as legislation promises to revolutionize the realm of online gambling for operators and players alike. Recently given the green light by President Dina Boluarte, these game-changing laws are set to take effect on July 18, 2022. The primary objective is to regulate the industry, ensure fairness, and establish a safer gambling environment for consumers in Peru.

One notable provision in the new legislation is the mandate for online gambling businesses to utilize a Peruvian domain address. This measure aims to enhance transparency and accountability within the sector, ensuring that operators are duly licensed and regulated by Peruvian authorities. Additionally, the licensing process will be more rigorous than ever before, with the cost of a license skyrocketing to an impressive Sol2.97 million ($814,000/£643,000/€746,000). Consequently, only esteemed brands with substantial financial resources will be granted permission to operate within the country.

Under the new laws, Peruvian players will only be able to place bets on sporting events affiliated with national or international sports associations. This safeguard protects consumers from engaging in illegal gambling activities while promoting responsible gambling practices. Furthermore, only licensed businesses will be permitted to sponsor teams or events, bolstering the industry’s credibility and integrity.

Peru already boasts a thriving gambling market, with Inkabet, owned by the renowned Betsson group, leading the pack in terms of market awareness among Peruvian consumers. Domestic operators such as Te Apuesto and Betara also enjoy a robust presence. However, the new regulations will introduce significant changes to ensure fair competition among all operators.

Previously, foreign operators could exploit a loophole in the initial legislation, Law No 31,557, allowing them to evade tax obligations. The new laws have effectively closed this loophole by establishing a tax rate of 12% on revenue. This ensures that all operators, regardless of their geographical location, contribute their fair share to the Peruvian economy.

Critics argue that the new laws do not adequately address businesses outside of Peru. While this concern holds some validity, it is crucial to recognize that this legislation represents a step in the right direction. Ongoing refinements can be made in the future to ensure fairness for all operators.

Another significant requirement imposed by the new laws is the implementation of robust know-your-customer (KYC) protocols by operators. This measure serves to combat money laundering and safeguard vulnerable individuals from potential risks associated with online gambling.

Law No 31,806, a series of amendments to Peru’s gaming regulations, has been hailed as a game-changer for the industry. President Pedro Castillo, who signed the legislation into law in August 2022, firmly believes that these changes will foster a more equitable and secure gambling environment for all Peruvian players.
